31. On 31 December 2009 the Government informed the Court that they proposed to make a unilateral declaration with a view to resolving the issues raised by the application. The Government acknowledged the breach of the applicant's right guaranteed by Article 11 of the Convention and undertook to pay the applicant the global sum of 3,000 euros (EUR). This sum would be payable within three months from the date of notification of the judgment taken by the Court pursuant to Article 37 1 of the European Convention on Human Rights. In the event of failure to pay this sum within the said three-month period, the Government undertook to pay simple interest on it, from the expiry of that period until settlement, at a rate equal to the marginal lending rate of the European Central Bank during the default period, plus three percentage points. They further requested the Court to strike out the application in accordance with Article 37 of the Convention.
