85. The Court considers in that connection that irrespective of whether
Mr Kasparov, Mr Tarasov and Mr Toropov were heading to an authorised
public gathering, as they alleged, or were already in the process of
conducting an unauthorised rally, as the Government claimed, their arrest KASPAROV AND OTHERS v. RUSSIA JUDGMENT 21
constituted an interference with their right of peaceful assembly, as did the
ensuing administrative charges brought against them. The Court observes,
moreover, that the Government did not dispute the existence of the
interference with the right to peaceful assembly in the present case.
