It is common ground between the parties that the “interference” in the present case consisted in the applicant being taken to the police station and held there for some time, and his prosecution for an administrative offence. The impugned measures entail a violation of Article 11 of the Convention unless they are prescribed by law, sought to pursue at least one of the legitimate aims mentioned in Article 11 § 2 and were necessary in a democratic society.
