The domestic courts found it established, moreover, that the first and second applicants had resisted being escorted away from the site by the police, which, like the blocking of the railroad passage, was in the very nature of the obstructive protest tactic used by the Gorky Park protesters. What is more, one of the police reports in the second applicant’s administrative-offence case file explicitly states that he was arrested for having protested on the construction site in the park (see paragraph 49 above).
