Case 100_127
100_127 substantive_scope
127. <37> The applicants argued that the fact that they were fined for
organising and/or participating at the CDPP gatherings amounted to a
breach of their right to freedom of assembly as guaranteed by Article 11 of
the Convention. According to them, the present case was to be distinguished
from Ziliberberg v. Moldova ((dec.), no. 61821/00, 4 May 2004) because
the CDPP gatherings were peaceful, they concerned a matter of major
public interest and contributed to a public debate, and that the highest fines
possible under the law had been applied to them.
