Case 100_145
100_145 substantive_scope
145. <41> In such circumstances, and in view of the fact that the present
applicants were members and/or supporters of the CDPP organising and/or
participating at the latter’s peaceful gatherings, the Court cannot but reach a
conclusion similar to that in Christian Democratic People’s Party, namely
that the interference with their freedom of peaceful assembly was not
proportionate to the aim pursued and that it did not meet a “pressing social
need”.
